1. Acceptance of Terms
By accessing or using the Genesis AI website (genesis-ai.me), platform, or consulting services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and clients of Genesis AI.
2. Services
Genesis AI provides two primary services: (a) the Genesis AI Platform, an AI-native contact center platform, and (b) Applied AI Consulting services. Access to the platform is provided on a subscription basis as described in our pricing plans. Consulting engagements are scoped individually under separate statements of work.
3. User Accounts and Access
Platform clients are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You agree to notify us immediately of any unauthorized use of your account. Genesis AI reserves the right to suspend or terminate accounts that violate these terms.
4. Fees and Payment
Platform fees are billed monthly or annually as agreed upon at the start of your subscription. Setup fees are one-time charges due before platform activation. Runtime costs (voice minutes, speech-to-text, AI tokens, and phone numbers) are billed at cost through our technology partners. All fees are non-refundable unless otherwise specified in your service agreement. We reserve the right to modify pricing with 30 days' notice.
5. Acceptable Use
You agree not to use our services to: (a) violate any applicable laws or regulations; (b) transmit harmful, offensive, or illegal content; (c) attempt to gain unauthorized access to our systems; (d) interfere with or disrupt the platform; (e) use the AI voice agents for fraudulent, deceptive, or harassing communications; or (f) resell or redistribute access without authorization.
6. Intellectual Property
All intellectual property rights in the Genesis AI Platform, website, documentation, and branding remain with Genesis AI. Clients retain ownership of their data processed through the platform. Consulting deliverables are owned by the client upon full payment unless otherwise agreed in the statement of work.
7. Data Protection and Compliance
Genesis AI processes data in accordance with our Privacy Policy and applicable data protection regulations. Our platform supports HIPAA, GDPR, and PCI-DSS compliance frameworks. Clients are responsible for ensuring their use of the platform complies with regulations applicable to their industry and jurisdiction. Data processing agreements are available upon request for enterprise clients.
8. Service Availability
We target 99.9% platform uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.
9. Limitation of Liability
To the maximum extent permitted by law, Genesis AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
10. Termination
Either party may terminate platform subscriptions with 30 days' written notice. Genesis AI may suspend or terminate access immediately for violations of these terms. Upon termination, your data will be available for export for 30 days, after which it may be deleted in accordance with our data retention policies.
11. Governing Law
These terms are governed by the laws of the Hashemite Kingdom of Jordan. Any disputes arising from these terms shall be resolved through the courts of Amman, Jordan, unless an alternative dispute resolution mechanism is agreed upon in writing.
12. Changes to Terms
We may update these Terms of Service from time to time. Material changes will be communicated to active clients via email. Continued use of our services after changes constitutes acceptance of the updated terms.
